Conditions of Use for the Kiita Connect alumni website and its subdomain (“Kiita’s Website) at www.kiitafoundation.com

Please read these conditions carefully before using the site. They apply to all users of and visitors to the site (“You”). As consideration for being allowed to use the site and by proceeding to use the site you signify that you agree to be bound by the following conditions (and documents referred to in them), as revised by Kiita from time to time. Revised conditions take effect when published.

“We” or “us” means Kiita Foundation.

Information about you and your visits to our site

We process information about you in accordance with our privacy policy and that of Kiita at www.kiitafoundation.com which both form part of these conditions. Aluminati also process information for their own purposes– see the Aluminati Data Protection Statement at _____________. Our website terms and conditions of use, where applicable, also apply to data provided by you to Aluminati and information derived from them.

By using our site, You consent to all such processing and warrant that all data You provide is true and accurate.

Service Provider

The site is operated by our supplier Aluminati Network Group Ltd of Hyperion House (First Floor), The Oaks, Fordham Road, Newmarket, Suffolk, CB8 7XN. Acting under instruction as our Data Processor under the Data Protection Acts 1998 and 2018. Aluminati will process personal data strictly for the purposes of operating this service.

Aluminati is registered with the Information Commissioner under membership number Z8393842.

Accessing our site

Your user password and any other piece of information provided as part of Kiita’s security procedures is confidential. You must not disclose it to any third party. You are responsible for making all arrangements necessary for You to have access to the site. You are also responsible for ensuring that all persons who access the site through your internet connection are aware of these conditions and comply with them. Access to the site is always at Kiita’s discretion and Kiita may withdraw or amend the services provided on the site without notice. From time to time Kiita may restrict access to some or all users to some or all parts of the site and sometimes the site may be unavailable. You use the site and the internet in general at your own risk. We use reasonable efforts to ensure the continuous operation and availability of the site and we use technologies to keep users’ data safe and accurate but we cannot and do not guarantee these things. Where possible we will post advance notice on the site where downtime is scheduled for maintenance. As is normal, you note the need to maintain backup copies of any important data. Whilst Kiita aims to update its site regularly the content on the site may be out of date at any given time.

If Kiita determines that You have breached any of these conditions, it may take such action as it deems appropriate, including disabling Your password whether chosen by you or allocated by us. You agree to indemnify us for all claims brought by a third party against us arising out of or in connection with any breach by You of any warranty set out in the conditions.

Uploading material to our site

Whenever You make use of a feature that allows You to upload material to Kiita’s site, or to make contact with other users of the site, You must comply with our acceptable use policy which forms part of these conditions. You warrant that any such contribution complies with that policy. Kiita retains the right to copy and use any material you upload for the purposes set out in our respective privacy policy and You grant a non-exclusive license royalty free for such purposes. If Kiita chooses to use any material You upload, we will try to contact You first. Kiita may view but does not actively monitor all material uploaded. Other users have the right to view material you upload to pages which are accessible by them. We may disclose Your identity if required by law or if requested by any third party who claims that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy

We do not assume responsibility or liability for the content or accuracy of any materials posted by you (or any other user of our site). We may remove any material or posting you make on our site if, in our opinion, such material does not comply with Kiita’s acceptable use policy.

Aluminati will report all complaints and breaches of which it is aware to the Kiita and will act as instructed by Kiita with respect to the data.

Intellectual property rights

Kiita is the owner or the licensee of all intellectual property rights in the site and in the material published on it, except to the extent material is collected and published by Aluminati for purposes set out in its data protection statement.

All Kiita material is protected by United States copyright laws, as well as copyright laws and treaties around the world. All such rights are reserved. You must acknowledge Kiita and that of any identified contributors as the authors of such material. Nothing contained in the site shall be taken, construed or considered as a grant of license or right to use the trademarks of Kiita or that of any third party displayed on the site without the prior written permission of the respective owner(s). Subject to statutory allowances, extracts of material from our site may be accessed, downloaded and printed for Your personal and non-commercial use and You may draw the attention of others to material posted on the site.

You may not modify the paper or digital copies of any material printed off or downloaded in any way and You must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. You must not use any part of the material on the site for direct or indirect commercial purposes or advantage without obtaining a license from Kiita or its licensors.

If You print, copy or download any part of the site in breach of these conditions, Your right to use the site will cease immediately and you must at our option return or destroy any copies of material made.

Linking to our site

You may link to the Kiita home page and Aluminati’s business home page, provided you do so in a way that is fair and legal and does not damage the owner’s reputation or take advantage of it, and You must not establish a link in such a way as to suggest any form of association, approval or endorsement where none exists. You must not establish a link from any website that is not owned by You. Kiita’s sites must not be framed on any other site, nor may You create a link to any part of our sites other than the home page. Kiita and Aluminati reserves the right to withdraw linking permission without notice. The website from which You are linking must comply in all respects with Kiita’s acceptable use policy.

Where Kiita’s site contains links to other sites or resources provided by third parties, these links are provided for Your information only. Kiita accepts no responsibility for them or for any loss or damage that may arise from Your use of them, and you must disclaim all claims against Kiita in exchange for Your use of the site. Kiita is not responsible for examining or evaluating. Kiita does not assume any responsibility or liability for the actions, products, and content of any of linked site or any other third-party.

Our liability Material posted on Kiita’s site, including material posted by You or other users or Aluminati, is not intended and does not amount to advice on which reliance may be placed.

Nothing in these terms of use is intended to exclude any liability for death or personal injury caused by proven negligence or fraudulent misrepresentation or any other liability which cannot be excluded or limited by law. Subject to that, neither Kiita nor Aluminati will be liable to You or any party for any of the following losses or damage even if the losses were reasonably foreseeable to both You and us when you began using the site: loss of data, loss of revenue or anticipated profits, loss of business, loss of opportunity, loss of goodwill or injury to reputation, loss suffered by third parties, any direct, indirect, special, incidental, or consequential loss or damages arising out of use of the site or reliance on any material or services provided in the site or accessed through it, whether or not amended by third parties and regardless of form of action and whether or not resulting from either of us breaching these conditions or from disruption, discontinuation or unavailability of the site at any time.
